Milk declarations

Milk declarations

Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1307/2001 and (EC) No 1234/2007, establishes that the first buyers of cow, sheep and goat milk must declare the amount of raw milk that was delivered to them in the previous month to the competent authority every month.

The monthly declaration system, which is linked to the obligatory nature of contracts between first buyers and dairy sector producers, has been subject to national regulations.

Royal Decree 319/2015, of 24 April, regarding declarations to be made by first buyers and cow, sheep and goat milk and dairy product producers, establishes the dairy sector unified information system (INFOLAC), which includes:

  • The registry of all first buyers who operate in the dairy sector in Spain
  • The information in all the contracts between first buyers and producers in the dairy sector, in accordance with Royal Decree 95/2019, of 1 March, establishing the conditions for procurement in the dairy sector and regulating recognition of the producer organisations and the inter-professional organisations in the sector, and which amends various royal decrees which are applicable to the sector.
  • The information regarding mandatory declarations in the dairy sector: Declarations of deliveries, direct sales and supplementary declarations

Furthermore, Royal Decree 153/2016 of 15 April, concerning mandatory declarations to be made by manufacturers of packaged liquid cow's milk, establishes the mandatory requirement of presenting a monthly declaration per client within the first twenty days of every month, through the INFOLAC IT application.

On 21 January 2021 Royal Decree 24/2021, of 19 January, Royal Decree 24/2021, of 19 January, which amends Royal Decree 319/2015, of 24 April, on the obligatory declarations to be made by the first purchasers and producers of milk and diary products from cows, sheep and goats, and Royal Decree 153/2016, of 15 April, on the obligatory declarations to be made by the producers of packaged liquid milk from cows, came into force.

In this RD, the transitory provision that conferred the function of the unified information system on the diary sector (INFOLAC) is repealed, assigned to the Ministry of Agriculture, Fisheries and Food through the Spanish Agrarian Guarantee Fund, O.A., changing this INFOLAC assignment to the Food Information and Control Agency O.A. (AICA).
